Terms and Conditions

These terms & conditions are applicable to the campaign Match Day Deals 2.1 (“Campaign”), organised by Takeaway.com Central Core B.V., with registered office at Piet Heinkade 61, 1019 GM Amsterdam (“Just Eat Takeaway.com” or “JET”).

General

  1. By participating in the Campaign you, hereinafter also referred to as “Participant”, declare to agree with these terms and conditions.
  2. The Campaign (“Promotion”) will start on 13/02/2024 at 00:00 hrs and ends on 09/05/2024 at 23:59 hrs (the “Campaign Period”). This includes the following UEFA Match days only:

  3. Participants that act in violation of these terms & conditions will be excluded from participation in the Campaign.

The Campaign

  1. The Campaign is enrolled on Pyszne.pl (“Platform”) in Poland and consists of one element:
    1. “Order to participate in the contest” UEFA Champions League final tickets, where a Customer who adds a Pepsi to their order during wave 2 of match days (09/04/2024, 10/04/2024, 11/04/2024, 16/04/2024, 17/04/2024, 18/04/2024, 30/04/2024, 01/05/2024, 02/05/2024, 07/05/2024, 08/05/2024, 09/05/2024) will be invited to the competition where they will have the opportunity to win a ticket for the UEFA Champions League Final match.
  2. Order to participate in the contest: to take part in the Campaign, the Participant has to:
    1. Place a successful and completed order via the Platform with a minimum order value of 85 PLN and add a Pepsi during wave 2 of match days of the Campaign Period;
    2. Subscribe to receiving Campaign related and other marketing emails from the Promoter;
    3. Once completed, the Participant will receive within 48 hours a confirmation email with an invitation to answer an open question regarding the UEFA Champions League Final night.
    4. The email will contain a “Reply” button clicking on which the Participant will be able to send its response.

    The answers (of max 250 characters) will be judged on creativity, originality and humour. The winner will be selected and announced on 15/05/2024.
    Participants are able to enter multiple times in the Campaign following the steps indicated in this Clause 2.3.

  3. No communication costs are charged by JET for participating in the Campaign.
  4. JET reserves the right to suspend, revoke or extend the Campaign at any time and may do so in its sole discretion.

Participants

  1. In order to participate, you need to be a resident of Poland.
  2. The Campaign is not open to employees of JET, of JET’s group companies, or of third parties JET engages for the execution of this Campaign, or in each case their immediate family members.
  3. A minimum age of 18 years is required for participation in the Campaign.
  4. JET may refuse or exclude Participants in its sole discretion, without giving a reason and without being liable for any damage of the Participant.

Prizes

  1. The awarded prizes are:
      1. Order to participate in the contest
        1. 1 pair x UEFA Champions League Final Tickets (including travel & accommodation)

    Approximate value of the overall prize will be €1500 EUR.

  2. As the prize awarded is Tickets to the UEFA Champions League Final (the “Tickets”), the following terms also apply:
    1. JET accepts no responsibility for any costs associated with any prizes which are not specifically and expressly included in that prize, including, without limitation, meals, personal expenses, insurance and additional travel expenses.
    2. A winner of the Tickets:
      1. must be able to travel during the time periods required for the applicable event date;
      2. will be responsible for all their (and any companion’s) travel arrangements (including any applicable insurances);
      3. will also be responsible for ensuring any travel arrangements they make in connection with the Tickets, complies with all applicable local and national government laws, regulations and guidance; and
      4. Must be available to be contacted by JET to provide some more details (including necessary personal data) and certain assurances to claim the Tickets.
    3. The Tickets are subject to the terms and conditions of any supplier(s) of relevant services included in the prize. For example, providers of hotel or other accommodation, event organisers and event rules and policies.   3. Prizes cannot be exchanged for cash, credit or other goods or services. In case of refusal of the prize and/or the prize cannot be accepted, the prize will remain the property of JET.
  4. Tickets are awarded for a predetermined match; the winner is not entitled to choose the match they would like to visit.
  5. The winner is strictly prohibited from selling their prize to any other person.
  6. By entering into the Campaign, the Participant acknowledges and agrees that the number of tickets available for the Campaign is dependent on the number of tickets allocated by UEFA to JET. JET may, at its sole discretion, unilaterally change the number of UEFA Champions League Final tickets to be awarded under or in connection with the Campaign if UEFA decides to amend the number of tickets that will be allocated. JET cannot be held liable for any losses, costs or damages arising from or related to such amendment.

    Prizes are personal and are not transferable.

    By entering the Campaign, you confirm that:

    1. Images, videos and other submissions are original works, are not defamatory and do not infringe third-party rights.
    2. There are no conflicting agreements in place that restrict usage of these images or other submissions.
    3. You have consent to use any third-party image in the entry and rights have been waived for that use. If a third party image is of a person under 18, parental or guardian consent must be provided.
    4. You will produce evidence of any required consents at the JET’s request, or risk being disqualified from entering the prize competition.
    5. You grant JET an irrevocable, royalty-free, worldwide, licence for the full term of copyright to use, alter, adapt or sub-license rights in the images, videos and other submissions to third parties.

Selection and announcing the winner

  1. The Participant who meets the eligibility criteria in Clause 2.3 and which response will show most creativity, originality and humour will be selected as a Winner.
  2. The Winner will be selected on the 15/05/2024.
  3. Within 48 hours, the winner will receive a direct message via their chosen platform with more information and next steps in order to claim their prize.
  4. The Winner of the UEFA Champions League Final tickets will receive an additional email from our partner ATPI with a request to provide certain assurances and submit necessary (personal) details. From the time of receiving this email, the winner has 24 hours to provide the requested details.
  5. If a Winner does not respond or does not adequately provide all requested details and assurances within 24 hours of being notified as per Clause 5.4, then the prize will be forfeited and JET will be entitled to select another winner, with reference to Clause 5.6 below.
  6. Several backup winners will be allocated in case of the instance where the prize is not collected by the primary winner in accordance with Clauses 5.4 and 5.5.
  7. The winner of the Campaign guarantees that the personal information provided to JET and the ticketing partner is correct, truthful and complete.

Privacy

  1. JET’s privacy statement https://www.pyszne.pl/en/privacy-statement and the General Data Protection Regulation apply to the personal information shared by Participants in connection to this Campaign.
  2. The personal information made available by the Participant to JET in connection to the Campaign is used to inform the Participant about the Campaign and to inform the Participant if he/she has won a prize. For these purposes, the personal data may also be transferred to our partner ATPI. This data will be deleted at the end of the Campaign Period.

Liability

  1. You acknowledge that participation in the Campaign is at your own risk.
  2. JET accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by an entrant or his/her/their eventual accompanying companions as a result of participating in the Campaign or in relation to any prize.
  3. JET takes great care in organising the Campaign, but the possibility that information presented regarding the Campaign is incomplete or incorrect cannot be entirely ruled out. Inaccuracies, spelling mistakes or comparable mistakes on the Campaign’s website or other Campaign materials published by JET of whatever nature, cannot be held against JET or cause any obligation for JET.
  4. Nothing in these Campaign terms and conditions shall exclude the liability of JET for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
  5. JET and third parties engaged by JET, are not liable for failures in network, hardware or software by social media channels that cause data to be delayed or lost.

Fraud

  1. JET retains the right to investigate the participation in the Campaign for any fraudulent activities and take any measures to end them. These measures may comprise that JET at its own discretion cancels an eligible order. Campaign entries earned through fraudulent activities or activities in violation of these terms and conditions will be null and void.

Others

  2. These Campaign terms and conditions will not be changed by JET during the term of the Campaign.
  3. Although the Promotion may be featured on or promoted using Facebook, Tiktok Instagram, & X, the Promotion is run by JET and is in no way sponsored, endorsed or administered by Facebook, Tiktok, Instagram, & X and you agree that Facebook, Tiktok, Instagram, & X are not liable in any way. By participating in the Promotion, you are providing your information to JET and not to Facebook, Tiktok, Instagram, & X.
  4. Dutch law applies to these terms and conditions. Any dispute arising from this campaign or these conditions will be submitted to the competent court in Amsterdam.
  5. Any gambling taxes due in respect of this Campaign and/or any withholding tax that must be withheld from a prize are for the account of JET.
  6. Any taxes (other than gambling taxes) due in respect of this Campaign is for the account of the winner.
  7. A winner should consult their own (tax) advisors regarding the local tax and legal consequences of winning a prize as won prizes may need to be declared to the local (tax) authorities.
